Abstract

Koordinasi antara pihak Hukum Sudbit Keamanan dengan Penyidik Subdit Narkoba dilakukan berdasarkan pada: SKEP KaPolri No. Pol.: SKEP/448/IX/2007 tanggal 14 September 2007 tentang Pedoman Produk Intelijen Di Lingkungan Polri, melalui koordinasi ini, sangat berguna untuk mengungkap kasus-kasus tindak pidana narkotika yang besar, salah satunya adalah kasus LP/ 234/VI/2018/SPKT-SBR Tanggal 01 Juni 2018. Penelitian ini merupakan penelitian deskriptif analitis. Adapaun hasil penelitian Koordinasi Sudbit Keamanan dengan Penyidik Subdit Narkotika dalam mengungkap kasus tindak pidana narkoba dimulai dari informasi masyarakat yang disampaikan kepada Sudbit Keamanan ataupun kegiatan yang dicurigai oleh Sudbit Keamanan, setelah mendapat informasi A 1, maka akan disampaikan kepada Kanit 1 dan dibuat laporan informasi. Laporan informasi ini akan diserahkan kepada dirintelkam, dirintelkam akan menyampaikan laporan informasi ini kepada dirresnarkoba, maka dirresnarkoba akan memerintahkan Subdit Narkotika untuk melakukan pengecekan lapangan untuk mengungkap kasus besar tersebut. Koordinasi Sudbit Keamanan dengan Penyidik Subdit Narkotika dalam mengungkap kasus tindak pidana narkoba biasanya berbentuk teknik pembelian terselubung. Kendala koordinasi Sudbit Keamanan dengan Penyidik Subdit Narkotika, bisa dilihat dari kurangnya jumlah peralatan yang diperlukan, terbatasnya biaya operasional, kendala penyidik setelah melakukan pembelian terelubung Sedangkan kendala-kendala eksternal yang muncul saat Polri menangani tindak pidana narkotika yang dilakukan dengan teknik pembelian terselubung, kendala dalam mendapatkan informan dan kendala menentukan lokasi, Upaya-upaya Polri dalam mengatasi kendala-kendala dapat berupa upaya secara preventif yaitu upaya yang dilakukan sebelum tindak pidana terjadi maupun secara represif yaitu upaya yang dilakukan setelah tindak pidana

Abstract

Article 197 Law number 36 of 2009 concerning Health stipulates that "everyperson who intentionally produces or distributes pharmaceutical preparations and / ormedical devices that do not have a distribution permit is given criminal sanctions andfines". For this matter, it is necessary to grant permits in the distribution ofpharmaceutical preparations, to protect the public from pharmaceutical preparations thatdo not meet the requirements, protect the public from misuse and misuse of pharmaceuticalpreparations and medical devices. This needs supervision from the Police in supervisingpharmaceutical preparations, this is done by Satreskrim Solok City Police, who havereceived a Police Report from the community on December 13, 2016. This research is adescriptive analytical study. Adapaun the results of research on law enforcement at thelevel of investigation of perpetrators of criminal acts of distribution of pharmaceuticalpreparations without permission in the city of Solok occurred in the report on December13, 2016, after the report was received, Satok District Police issued LP / 89 / A / XII /2016-SEKTA, then Investigation, Investigation, Examination of witnesses, Information ofExperts, Suspects and determining the elements of the Criminal Act which are suspected ofbeing violated by the suspect. Secondly, the obstacle encountered by Solres Kota police inlaw enforcement against criminal acts circulating pharmaceutical preparations withoutpermission in Solok City: a) Limited budget funds; b) Number of Investigators who are notbalanced with the breadth of work area; c) Modus Operandi carried out by the perpetratoris always changing; d) Other agencies that are less cooperative; e) expert witnesses aredifficult to bring; and f) Difficulties in bringing and presenting witnesses concerned withcases of pharmaceutical preparations without permission to eat the old procedure, becausethere are several witnesses who do not want to come or even not be asked to be questionedby members of the auxiliary investigators who examine. Third, efforts to overcome theobstacles in law enforcement against criminal acts circulating pharmaceuticalpreparations without permission in the city of Solok, by making repressive efforts andPreventive efforts.

Abstract

Investigation of criminal cases committed by children by police investigators inaccordance with Law Number 8 of 1981 concerning Criminal Procedure Law (KUHAP)and Law Number 11 of 2012 concerning the Child Criminal Justice System. The PariamanPolice PPA Unit handles at least 10 cases of child offenders who coordinate with the WestSumatra Child Protection Agency and P2TP2A Limpapeh Nan Gadang House, WestSumatra Province, so that the investigation process can proceed well. This research is adescriptive analytical study. The research results of the coordination of the PPA andP2TP2A Units in conducting investigations at the Padang Pariaman Regional Policebegan with the psychological assistance process of child offenders in the investigationprocess, medical assistance process, legal advocacy process in investigations, so that thechild investigation process was quickly carried out and in accordance with the ProtectionAct and the Child Criminal Justice System Act. Constraints encountered in thecoordination of the PPA and P2TP2A Unit in conducting investigations were theLimitations on the Number of Child Investigators Understanding Children's Investigations,the Limitations of the Number of West Sumatra LPA Members, the Limited Number ofP2TP2A Members, the Maximum Coordination between PPTP Units and P2TP2A in theInvestigation Process, and Child Factors / Family Actors who are less responsive in theinvestigation process. Addressing the obstacles encountered in the coordination of theProtection of Women and Children with the West Sumatra Child Protection Agency inconducting investigations at the Padang Pariaman Regional Police by means of trainingand cooperation with the West Sumatra Child Protection Agency and P2TP2A LimpapehNan Gadang House, West Sumatra Province, system cross subsidies between units,increased socialization related to the issue of child protection for the community, andmodernizing the juvenile justice system in accordance with community development.

Abstract

Crime of theft that has a loss value of under two million five hundred rupiahbased on Article 1 and Article 2 of the Supreme Court Regulation Number 2 of 2012concerning Adjustment of Light Tipring and the Amount of Fines in the Criminal Codequalify as a misdemeanor. As a misdemeanor, the investigation and trial process iscarried out with a quick event. However, in practice, problems and constraints faced bylaw enforcement officers who are members of the criminal justice system arise,especially the police as investigators who are authorized by law to implement theprovisions of the Regulation as happened in the investigation of criminal cases of theftin the Resort Police Criminal Investigation Unit Padang City.

Abstract

Tindak pidana yang dilakukan oleh anak maupun korbannya adalah anak banyak terjadi di sekitar kita.Salah satu yang sering terjadi sekarang ini adalah penyalahguna narkotika.Anak memiliki sifat dan keadaan psikologis yang masih belum stabil dan memerlukan pengawasan terhadap tindakan-tindakan yang pada hakekatnya dapat merugikan perkembangan mental maupun jasmani anak.Pemeriksaan terhadap anak dilakukan di bagian tersendiri yang terpisah dari bagian orang dewasa. Akan tetapi hak-hak anak seringkali tidak dilindung di dalam proses peradilan pidana, mulai dari proses penyidikan hingga proses di pengadilan. Polisi sebagai garda terdepan proses penyaringan perkara pidana yang melaksanakan penyelidikan dan penyidikan terhadap orang yang melakukan tindak pidana narkotika dalam hal ini merupakan instansi pertama dalam sistem peradilan pidana.

Abstract

The guidance function has been carried out in an integrated manner between theTrustees and those who are fostered and the community to improve the quality ofcorrectional facilities. It is intended that the wargabinaan be aware of their mistakes andimprove themselves so as not to repeat the criminal acts in the future. Pancasila as theideal foundation of the correctional system, mentions the existence of balance andharmony both in human life as a person, and in relations with society in relation to nature,as well as relations with God. The implementation of prisoner guidance to prevent theoccurrence of repetitions of crime is guided by Law No. 12 of 1995 concerning Prisoners,prisons strongly uphold the human rights of every human being, guidance provided to theassisted people is only intended so that the inmates will no longer repeat criminal actsafter free from criminal sanctions imposed upon him for acts he has committed so thatafter being returned to the community, the assisted citizens can become good individualsand obey the applicable law. The obstacle faced by the correctional institutions in carryingout guidance to prisoners is over capacity in terms of the number of prisoners not inaccordance with the capacity provided, the number of employees who are not inaccordance with the number of prisoners and another obstacle is the placement ofprisoners.

Abstract

One of the basic principles of contract law is the principle of Freedom of Contract.As the name implies, the principle dictates that private or public individuals and groupsare free to form contracts without any restriction. As free as it is, the principle howeverdoes have some restriction, In the Indonesia Civil Code (Kitab Undang-Undang HukumPerdata) there are some provisions that limits such freedom. Article 1320 of IndonesiaCivil Codes stipulates four conditions to be fulfilled in order an agreement to be valid.Others limitation could come from any other laws and regulations such as the PresidentialRegulation Number 16 of 2018 Regarding The Government’s Procurement Of Goods andServices. The principle of freedom of contract bestows a great number of authorities to theCommitment Making Officer in terms of making procurement agreements with provider.However, such authority doesn’t go as well in practice, breach of contract and abuse ofpower by the officer are some of the common problems in the government’s procurement.This thesis analyzes those problems, specifically that indicates corruption in theprocurements by the Office of Public Work of Sijunjung Regency.
